Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between you ("User", "you", or "Seller") and FastFly ("FastFly", "we", "us", or "our") governing access to and use of the FastFly website, software, dashboard, page builder, hosting, analytics, payment integrations, and related services (the "Service").

By registering an account, starting a free trial, purchasing a plan, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Governing law and jurisdiction

These Terms are governed by the laws of the People's Republic of Bangladesh, including without limitation (as applicable):

  • The Contract Act, 1872;
  • The Information and Communication Technology Act, 2006 (as amended);
  • The Cyber Security Act, 2023;
  • The Consumer Rights Protection Act, 2009;
  • The Copyright Act, 2000 (as amended);
  • Applicable Bangladesh Bank / payment-system rules for digital payments; and
  • Any other statute, rule, or regulation applying to online services and e-commerce in Bangladesh.

Subject to mandatory consumer protections, disputes shall be subject to the exclusive jurisdiction of the competent courts in Dhaka, Bangladesh. Nothing in these Terms limits rights that cannot be waived under Bangladesh law.

2. Eligibility and account registration

  1. You must be at least 18 years old and capable of entering a binding contract under Bangladesh law.
  2. You must provide accurate registration information and keep it updated.
  3. You are responsible for all activity under your account and for safeguarding passwords and access tokens. Notify us promptly of any unauthorised use.
  4. One person or business entity may not maintain multiple accounts to abuse trials, pricing, or fair-use limits without our written consent.
  5. If you register on behalf of a company or partnership, you represent that you are authorised to bind that entity.

3. Description of the Service

FastFly provides software tools for Bangladeshi Facebook sellers and marketers, including (depending on your plan):

  • Drag-and-drop landing page and mini-store building;
  • Subdomain publishing and optional custom domain connection;
  • Product catalogues, coupons, and order management;
  • Cash on Delivery (COD) checkout and bKash payment flows;
  • Analytics, tracking integrations (e.g. Facebook Pixel / CAPI); and
  • Team and notification features as made available.

FastFly is a technology platform. We do not manufacture, own, or guarantee the products you sell, and we are not a party to sales contracts between you and your end customers, except where we expressly process a payment as a technical intermediary.

4. Plans, fees, and billing

  1. Plan features, limits, and prices (typically in BDT) are shown on the pricing page or in your dashboard and may change with notice.
  2. Free trials or free tiers, if offered, are subject to fair use and may be modified or withdrawn.
  3. Paid subscriptions renew according to the selected billing cycle unless cancelled before renewal in accordance with the cancellation controls in the dashboard (or by written notice where those controls are unavailable).
  4. Fees are generally non-refundable once a billing period has started, except where required by Bangladesh consumer law or expressly stated by FastFly in writing.
  5. You are responsible for applicable VAT, taxes, or government charges on FastFly subscription fees.
  6. Failure to pay may result in suspension or termination of paid features, unpublished sites, or account restriction.
  7. FastFly charges a platform subscription fee. Unless a plan expressly states otherwise, FastFly does not take a percentage commission on your COD or bKash order amounts.

5. Seller obligations and acceptable use

You agree that you will:

  • Use the Service only for lawful business purposes and in compliance with Bangladesh law and these Terms;
  • Provide true descriptions of products, prices, shipping charges, and delivery timelines to your customers;
  • Honour confirmed orders, COD confirmations, and refund/return policies you publish, consistent with the Consumer Rights Protection Act, 2009 and fair trading practices;
  • Not sell illegal, prohibited, counterfeit, harmful, or restricted goods or services under Bangladesh law;
  • Not use the Service for fraud, phishing, spam, malware, hate content, pornography involving minors, terrorism financing, money laundering, or any cyber offence under the Cyber Security Act, 2023 or ICT Act;
  • Not infringe intellectual property, privacy, or personality rights of others;
  • Not attempt to reverse engineer, scrape, overload, or disrupt the Service except as allowed by mandatory law;
  • Not misrepresent affiliation with FastFly, government agencies, or payment brands (including bKash); and
  • Maintain any licences or registrations required for your own business (trade licence, VAT, etc.) where applicable.

We may investigate suspected violations and remove content, suspend sites, or terminate accounts without prior notice where necessary to protect users, the public, or the platform.

6. Your content and intellectual property

  1. You retain ownership of content you upload (text, images, branding, product data). You grant FastFly a worldwide, non-exclusive licence to host, store, display, and process that content solely to provide and improve the Service.
  2. You represent that you have all rights needed to use and publish such content.
  3. FastFly and its licensors own the Service software, templates (except your customisations), branding, and documentation. You receive a limited, revocable, non-transferable licence to use the Service during your subscription, subject to these Terms.
  4. Feedback you provide may be used by FastFly without obligation to you.

7. Domains, publishing, and availability

  • Subdomains on FastFly infrastructure remain under our naming and acceptable-use policies. We may reclaim inactive, abusive, or trademark-infringing subdomains.
  • Custom domains require correct DNS configuration by you. Domain registration itself (if purchased elsewhere) is governed by your registrar.
  • We aim for high availability but do not guarantee uninterrupted or error-free operation. Scheduled maintenance and force majeure events may cause downtime.

8. Payments, COD, and third-party services

  1. bKash and other gateways: Payments are processed by third parties under their terms. You must comply with merchant rules and Bangladesh Bank / MFS requirements. FastFly is not liable for gateway outages, declined payments, or disputes between you and the payment provider, except to the extent caused by our proven negligence in transmitting order data.
  2. COD: You alone are responsible for verifying orders, delivery, collection of cash, and handling refusals or returns.
  3. Meta / WhatsApp / analytics tools: Enabling these integrations is optional and subject to those providers' terms and advertising policies.

9. Privacy and data protection

Processing of personal data is described in our Privacy Policy. You must handle your customers' personal data lawfully, keep it secure, and not use FastFly to violate privacy rights. You remain responsible for privacy notices on your storefronts.

10. Consumer-facing sales (your customers)

When end customers buy from your FastFly-hosted pages, the contract of sale is between you and the customer. You must:

  • Disclose seller identity and contact details reasonably clearly;
  • State price, delivery cost, and payment method before order confirmation;
  • Avoid unfair, misleading, or deceptive advertising under Bangladesh consumer protection norms; and
  • Handle complaints, refunds, and replacements in good faith and as required by law.

FastFly is not a marketplace guarantor of product quality and is not liable to end customers for your products or fulfilment failures.

11. Prohibited content and moderation

We may refuse, remove, or disable content or sites that appear to violate these Terms, Bangladesh law, or the rights of others, or that create security, legal, or reputational risk. You may appeal via support@fastfly.io, but we retain final discretion for platform safety.

12. Warranties and disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by Bangladesh law, FastFly disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet every business goal, that templates will convert at any particular rate, or that third-party integrations will remain available indefinitely.

13. Limitation of liability

To the maximum extent permitted by Bangladesh law:

  • FastFly shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from use of (or inability to use) the Service;
  • FastFly's total aggregate liability arising out of these Terms or the Service shall not exceed the fees you paid to FastFly for the Service in the three (3) months immediately preceding the claim; and
  • Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited under mandatory Bangladesh law.

14. Indemnity

You agree to indemnify and hold harmless FastFly and its officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your content or products; (b) your breach of these Terms or applicable law; (c) disputes with your customers or payment providers; or (d) infringement of third-party rights.

15. Suspension and termination

  1. You may stop using the Service and request account closure at any time.
  2. We may suspend or terminate access immediately for non-payment, legal risk, security incidents, or material breach of these Terms.
  3. Upon termination, your licence to use the Service ends. We may delete or disable published sites after a reasonable wind-down period, subject to legal retention duties. Export any content you need before closure.

16. Changes to the Service and Terms

We may modify features, plans, or these Terms. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by notice in the dashboard or by email. Continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service and cancel your subscription.

17. Force majeure

FastFly is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, epidemic, government action, power or internet failure, labour disputes, or third-party service outages.

18. Miscellaneous

  • These Terms, together with the Privacy Policy and any plan-specific notices, are the entire agreement between you and FastFly regarding the Service.
  • If any provision is held unenforceable, the remaining provisions remain in effect.
  • Failure to enforce a provision is not a waiver of that provision.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
